The following are the Terms of Use that are applied in all our pages, subdomains, features, and services provided by us at musikerkennung.com.

By accessing and using the Musik Erkennung services, you confirm that you are in agreement with and bound by the terms and conditions contained in the Terms of Service outlined below. These terms apply to the entire website. If you do not agree with any or all of these terms or our Privacy Policy, you should not use or access our website.

Musik Erkennung is a music and audio recognition service offered by means of its website. Musik Erkennng provides services, tools, and interfaces allowing:

  • recognizing and matching music tracks in your media files, either by uploading them or by providing their links;
  • recognizing and matching music tracks in your social media videos by providing their links (Facbook & Instagram videos and reels, Youtube videos and shorts, Tiktok videos, X/Twitter videos);
  • acquisition of information on music tracks as well as related music in terms of genre;
  • performing manual or automated audio recognition via its web interface, and providing other related services;

QUALITY OF SERVICE

By using the Site, you represent and warrant that you will not impose any claims to the Service administration (hereinafter “Administration”), its owners, and Affiliates, with respect to the service quality and correctness of the information that the Service provides. In particular, you will not impose any claims related to the accuracy of the audio recognition results, details, and information on the recognized audio materials.

You acknowledge that the Service is provided to you strictly on an “as is” basis and that the Service Administration, its owners, and Affiliates make no warranty or representation whatsoever as to the fitness for purpose of the Service or its functionality and performance (fingerprint calculation time, robustness and resistance to audio distortions, matching time, search time, other response times, information accuracy) for any particular purpose for which you may intend to use the Service.

SERVICE USE

Musik Erkennung DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE, OR FEATURE OF THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC RESULTS. THE SITE, ITS CONTENT, AND SERVICE ARE DELIVERED AND PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS.

You understand and agree that you use the Service at your own risk and that you will be solely responsible for any possible consequences that such use or misuse may have or result in. All responsibilities and liabilities towards users, customers, and third parties remain solely with you, all without recourse against Musik Erkennung, its owners, and its employees. You acknowledge that Musik Erkennung, its owners, and its employees, shall not be liable for any direct or indirect damage caused to you by using the Service.

By using the Service and the Site, you acknowledge that you have read, understood, and agreed to this TOU. If you do not agree with any aspects of this TOU, you should not use the Site.

You may not use any “deep-link,” “page-scrape,” “robot,” “spider,” or other automatic device, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or its underlying platform or any Content, to obtain or attempt to obtain any materials, documents, or information through any means not purposely made available through the Site.

You may not attempt to gain unauthorized access to any portion or feature of the Site or any other systems or networks connected to the Site or to any Musik Erkennung server, or to any of the services offered on or through the Site, by hacking, password “mining,” or any other illegitimate means. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site, Musik Erkennung systems or networks, or any systems or networks connected to the Site or to Musik Erkennung.

You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site, any transaction being conducted on the Site, or any other person's use of the Site.

You agree to not reverse-compile or decompile, analyze, reverse-engineer, reverse-assemble or disassemble, unlock, or otherwise attempt to discover the source code or underlying algorithms of Musik Erkennung or attempt to do any of the foregoing in relation to the Musik Erkennung service.

You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to Musik Erkennung on or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else or impersonate any other individual or entity.

Don't use our services and intellectual property for any form of infringement.

You are responsible only for the data (e.g., files, URLs) that you send to the Musik Erkennung service. Musik Erkennung does not monitor user content. Please remember that illicit exchanges of recordings protected works and hacking harms artistic creation. And please respect the laws in force, especially those concerning intellectual and artistic property.

Musik Erkennung does not claim any copyrights to the audio recordings and/or their information associated with them (hereinafter “Content”) uploaded to and/or hosted at and/or transmitted via and/or shared through and/or delivered via (hereinafter “posted” on) the Service.

PRIVACY POLICY

Musik Erkennung's Privacy Policy applies to the use of this Site, and its terms are made a part of these Terms of Use by this reference. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
